Refunds and Returns Policy

eSpree is an online marketplace made up of independent vendors, and each vendor may offer their own returns policy for the Products they sell. We encourage our vendors to offer fair and flexible return options wherever possible; however, certain Products may have specific return conditions due to their nature.

You can find the applicable vendor’s returns policy on each Product page, below the Product description under the “Returns Policy” tab. We encourage you to read this information before completing your purchase.

Your Consumer Rights

A vendor’s returns policy is additional to, and does not replace or limit, any rights or remedies you may have under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), or other applicable South African law.

Where you have a statutory right to cancel a transaction, return a Product, or request a repair, replacement or refund, that statutory right will apply regardless of any more restrictive provision contained in an individual vendor’s returns policy.

Where a vendor voluntarily offers a returns or exchange policy that provides additional rights beyond those required by law, the terms of that vendor’s policy will apply to those additional returns.

Defective, Damaged or Incorrect Products

If a Product is defective, unsafe, damaged, incorrectly supplied or otherwise does not meet the standards required by applicable consumer law, please contact eSpree or the relevant vendor as soon as reasonably possible so that the matter can be assessed and the appropriate remedy provided.

Nothing in a vendor’s returns policy or eSpree’s Terms and Conditions excludes, restricts or limits a consumer right or remedy that may not lawfully be excluded, restricted or limited.

Monthly Free Shopping Draw

Returning or cancelling a purchase may affect an entry associated with that purchase in the eSpree Monthly Free Shopping Draw.

The treatment of competition entries associated with cancelled or refunded purchases is governed by the separate Monthly Free Shopping Draw Competition Rules. Nothing in those Competition Rules limits your statutory rights to cancel or return a Product or to receive a refund or other remedy where required by applicable law.
