Monthly Free Shopping Draw Competition Rules
1. Introduction
The eSpree Monthly Free Shopping Draw (“Competition”) is a promotional competition operated by eSpree (“Promoter”).
These Competition Rules govern participation in the Competition and must be read together with eSpree’s General Terms and Conditions, Returns & Refunds Policy and Privacy Policy.
Participation in the Competition does not exclude, restrict, waive or replace any statutory consumer right or remedy available under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), or other applicable South African law.
2. No Additional Charge to Enter
Participation in the Competition is offered at no additional charge to Buyers making qualifying purchases through eSpree.
No separate entry fee is charged and no portion of the purchase price constitutes a separate charge for participation in the Competition.
Products are not priced higher as a result of their inclusion in the Competition.
3. Competition Period
A new Competition takes place during each calendar month.
Each monthly Competition opens at 00:00 on the first day of the applicable calendar month and closes at 23:59 on the final day of that calendar month, South African Standard Time (“Competition Period”).
Qualifying purchases successfully completed during a Competition Period generate entries into the draw relating to that Competition Period.
Entries do not carry over between monthly Competition Periods except where expressly stated in these Rules.
4. Who May Participate
The Competition is open to natural persons who:
- are legally entitled to make the relevant purchase and participate in the Competition;
- make a qualifying purchase through eSpree during the applicable Competition Period; and
- comply with these Competition Rules.
Any persons who are prohibited from participating under applicable South African promotional competition legislation are excluded from participation.

5. How Entries Are Earned
Each qualifying Product purchased through eSpree during the applicable Competition Period generates one base entry into that month’s Competition.
For example, a qualifying order containing three qualifying Products will generate three base entries.
Each entry is associated with the specific qualifying Product and transaction from which it arose.
There is no additional charge for an entry.
6. Promotional Entry Multipliers
From time to time, eSpree may offer promotional entry multiplier codes (“Multiplier Codes”) that increase the number of Competition entries generated by a qualifying purchase.
A Multiplier Code does not increase or otherwise affect the purchase price of a Product and no additional fee is charged for using a Multiplier Code.
A Multiplier Code applies separately to each qualifying Product in the transaction. For example, an X3 Multiplier Code causes each qualifying Product to generate three entries instead of its standard one base entry.
For example:
- an order containing three qualifying Products ordinarily generates three base entries;
- where a valid X3 Multiplier Code applies to that order, those three base entries are multiplied by three; and
- the Buyer therefore receives nine entries into the applicable Monthly Draw.
Multiplier Codes may be offered for limited promotional periods or special occasions. eSpree will communicate the applicable Multiplier Code, multiplier value, promotional period and any specific eligibility requirements when the promotion is offered.
Unless expressly stated otherwise:
- only one Multiplier Code may be applied to a qualifying transaction;
- Multiplier Codes cannot be combined or multiplied with one another;
- a Multiplier Code applies only to qualifying Products and transactions completed during the period for which that code is valid;
- a Multiplier Code increases the number of entries generated by the qualifying purchase and does not increase the value of the Prize;
- Multiplier Codes have no cash value and cannot be exchanged, transferred or redeemed for cash; and
- expired, invalid or incorrectly entered Multiplier Codes will not generate additional entries.
The use of a Multiplier Code remains subject to these Competition Rules and any specific promotional conditions communicated with that Multiplier Code.
Effect of a Cancellation or Refund on Multiplied Entries
Where a qualifying Product or transaction that generated multiplied entries is cancelled or refunded before the applicable Monthly Draw in circumstances where the underlying entry no longer qualifies under these Competition Rules, all additional entries generated by the Multiplier Code in respect of that cancelled or refunded Product will also cease to participate in the draw.
For example, where three qualifying Products generate nine entries through an X3 Multiplier Code and one of those Products is subsequently cancelled and refunded before the draw, the three entries associated with that Product will no longer participate, while the entries associated with the remaining qualifying Products will remain unaffected, subject to these Competition Rules.
Nothing in this provision limits or penalises a Buyer’s exercise of a statutory right of cancellation, return or refund.
7. Ambassador Bonus Entry Codes
From time to time, eSpree may appoint participating Ambassadors and provide them with unique promotional codes (“Ambassador Codes”) that award additional Competition entries to Buyers.
Unlike a Promotional Entry Multiplier, an Ambassador Code provides a stated number of additional bonus entries for each qualifying Product in the transaction.
For example, where a valid +10 Ambassador Code is successfully applied, each qualifying Product generates its standard one base entry plus ten additional bonus entries, resulting in a total of eleven entries per qualifying Product.
Example
A Buyer purchases three qualifying Products and uses a valid +10 Ambassador Code:
- 3 qualifying Products generate 3 base entries;
- the Ambassador Code generates 10 additional entries for each qualifying Product, being 30 bonus entries; and
- the Buyer therefore receives 33 entries into the applicable Monthly Draw.
All eleven entries associated with each qualifying Product remain linked to that specific Product for the purposes of the Monthly Draw and determination of the Prize.
Ambassador Codes:
- provide the stated number of additional entries for each qualifying Product;
- do not increase the value of the Prize;
- do not increase the purchase price of a Product;
- carry no additional charge for the Buyer; and
- have no cash value and cannot be exchanged or redeemed for cash.
eSpree will communicate the applicable Ambassador Code, number of additional entries, validity period and any specific eligibility requirements when an Ambassador Code is offered.
A Buyer may use one valid Ambassador Bonus Entry Code together with one valid Promotional Entry Multiplier Code where both codes are available and valid for the applicable transaction. The Promotional Entry Multiplier will apply to the total number of entries generated for each qualifying Product after any applicable Ambassador Bonus Entries have been added. Unless expressly stated otherwise, a Buyer may apply no more than one valid Ambassador Bonus Entry Code and one valid Promotional Entry Multiplier Code to a qualifying transaction. Two Ambassador Codes or two Multiplier Codes may not be combined or stacked.
Example: Three qualifying Products generate 3 base entries. A +10 Ambassador Bonus Entry Code increases this to 33 entries (11 per Product). An X3 Promotional Entry Multiplier then triples those entries, resulting in 99 entries (33 per Product).
Cancelled or Refunded Products
Where a qualifying Product is cancelled or refunded before the applicable Monthly Draw and its underlying entry consequently ceases to qualify under these Competition Rules, the base entry and all Ambassador bonus entries associated with that Product will also cease to participate in the draw.
The cancellation or return of one Product does not affect entries associated with other qualifying Products in the same transaction, provided those Products and entries remain eligible.
Nothing in this provision limits or penalises a Buyer’s exercise of a statutory right of cancellation, return or refund.
8. Qualifying Purchases
For an entry to qualify:
- the Product must have been purchased through eSpree during the applicable Competition Period;
- the transaction must have been successfully completed;
- the purchase must be genuine and not fraudulent, fictitious or otherwise unlawful; and
- the transaction and entry must comply with these Competition Rules.
eSpree reserves the right to verify the transaction associated with a potentially winning entry before awarding the Prize.
9. Cancelled and Refunded Purchases Before the Draw
Where a qualifying Product or transaction is lawfully cancelled and fully refunded before the applicable Monthly Draw takes place, any Competition entry arising solely from that cancelled or refunded purchase will no longer participate in that draw.
Nothing in this provision prevents or discourages a Buyer from exercising a statutory right of cancellation, return or refund.
A Buyer’s entitlement to cancel a transaction, return a Product, or receive a refund or other consumer remedy is determined by applicable law and eSpree’s Returns & Refunds Policy and is separate from the rules governing Competition eligibility.
Where a return or refund is requested but has not yet been finalised at the time of the draw, eSpree may take reasonable steps to verify the status of the underlying transaction before confirming the eligibility of the relevant entry.
10. Returns Requested After the Draw
The Competition does not remove or reduce any statutory right a Buyer may have to return a Product or obtain a repair, replacement, refund or other remedy after the Monthly Draw.
A legitimate statutory return or consumer remedy will be handled in accordance with applicable law and eSpree’s Returns & Refunds Policy.
The Competition Rules must not be interpreted as imposing a penalty upon a Buyer for exercising a statutory consumer right.
11. The Monthly Draw
Following the close of each Competition Period, the entry pool for that month will be closed.
The Monthly Draw will take place on the 20th of the following calendar month.
One qualifying Product entry will be selected using an independent, verifiable random selection process.
The selected entry will be subject to reasonable verification of its eligibility under these Competition Rules.
eSpree will maintain appropriate records relating to the Competition and draw as required by applicable law.
12. The Prize
The Prize is an amount equal to 100% of the retail purchase price actually paid by the Buyer for the specific qualifying Product associated with the winning entry.
Only the purchase price actually paid for the winning Product is used to calculate the Prize.
The Prize does not include the standard R99 delivery fee, or any other delivery charge applicable to the original transaction.
Where a discount code, voucher or other price reduction was applied to the winning Product, the Prize will be calculated using the amount actually paid for that Product after the applicable reduction. Promotional Entry Multipliers and Ambassador Bonus Entry Codes do not affect the value of the Prize.
There is one winning Product entry and one Prize for each monthly Competition, unless expressly stated otherwise.
13. Payment of the Prize
The Prize will ordinarily be paid to the original payment method used to complete the qualifying transaction, where technically possible.
Where this is not reasonably possible, eSpree may arrange another appropriate payment method after verifying the winner’s identity and entitlement to the Prize.
No fee will be charged to the winner for receiving the Prize.
14. Winner Verification
Before awarding the Prize, eSpree may reasonably verify:
- the identity and eligibility of the selected participant;
- the qualifying purchase;
- the Product associated with the selected entry;
- the amount actually paid for the Product;
- that the transaction has not been cancelled or refunded before the draw; and
- that the entry otherwise complies with these Competition Rules.
Verification must be reasonable and will not be used to deprive a participant of a Prize to which they are lawfully entitled.
15. Notification of the Winner
The selected winner will be contacted using the contact information associated with their eSpree account or qualifying transaction.

eSpree may require reasonable information necessary to verify the winner and process payment of the Prize.

16. Announcement and Privacy
The results of the Monthly Draw will be communicated in the manner described in these Competition Rules and/or on eSpree.
eSpree will process personal information associated with the Competition in accordance with its Privacy Policy, POPIA and other applicable law.
A winner will not be required to permit the use of their image, likeness or personal information for promotional purposes beyond what may lawfully be required as a condition of receiving the Prize.
Any optional publicity or marketing participation will be dealt with separately and subject to applicable law.
17. Defective, Damaged or Non-Conforming Winning Products
Winning the Competition does not affect the Buyer’s statutory rights relating to the Product associated with the winning entry.
Where a winning Product is defective, unsafe, damaged, incorrectly supplied or otherwise fails to comply with applicable consumer law, the matter will be dealt with in accordance with the CPA, other applicable law and eSpree’s Returns & Refunds Policy.
The award or payment of the Competition Prize does not exclude or replace statutory consumer rights relating to the underlying Product.
18. Fraud, Manipulation and Abuse
eSpree may investigate entries where there are reasonable grounds to suspect fraud, manipulation, fictitious transactions, payment fraud, automated abuse or other unlawful conduct.
An entry may be disqualified where eSpree reasonably establishes that it was obtained through fraud, unlawful conduct or a material breach of these Competition Rules.
This provision will not be used to disqualify or penalise a Buyer merely because the Buyer has exercised a legitimate statutory right of cancellation, return or refund.
19. Independent Vendors
Products available through eSpree may be supplied by independent Vendors.
A Vendor’s individual Returns Policy governs any additional or voluntary return rights offered by that Vendor, while statutory consumer rights continue to apply in accordance with applicable law.
The Competition is operated by eSpree and the determination of Competition entries, conduct of the Monthly Draw and award of the Prize are governed by these Competition Rules.
20. Changes, Suspension or Cancellation of the Competition
eSpree may amend these Competition Rules where reasonably necessary to comply with applicable law or to address circumstances materially affecting the fair or lawful operation of the Competition.
Any material amendment will apply prospectively and will not retrospectively deprive a participant of rights already acquired under an existing Competition except where required by law.
Where circumstances beyond eSpree’s reasonable control prevent a Competition or draw from proceeding as planned, eSpree may take reasonable steps to suspend, postpone or modify the Competition, subject to applicable law and the rights of existing participants.
21. General Consumer Rights
Nothing contained in these Competition Rules:
- excludes, restricts or waives a statutory consumer right;
- removes a Buyer’s rights under eSpree’s Returns & Refunds Policy or applicable law;
- requires a Buyer to waive a statutory return or cooling-off right in order to participate;
- imposes a penalty for exercising a statutory consumer right; or
- limits any right or remedy that may not lawfully be excluded or restricted.
Where these Competition Rules conflict with a statutory consumer right that may not lawfully be excluded or restricted, the applicable statutory provision will prevail.
